Health and Safety Legislative Updates
TOSHA has been running quite a few sessions on Health and Safety Legislative Updates for clients over the last six months. These range from a condensed half day for senior managers, who have a good understanding. One day for line managers and supervisors who need that refresher and new information updates, through to a two day client specific and assessment that meets US 19521 “Explain the Requirements of the Health & Safety in Employment Act (HSE) 1992”. This unit standard is at Level 4 with 5 Credits.

What's that acronym?
There is often confusion within the workforce as to what the acronym of our incident/accident data really means e.g. FAI, MTI, LTI, TI, LTIS, LTIF. To help build a better understanding we have listed these acronyms as determined by most industries, in the upcoming Mass Mailer, so watch your inboxes! If you are not on our mailing list email us at intouch@tosha.co.nz

NZQA  NSN (National Student Number) Form
In order to register NZQA credits against a candidate's Record of Learning for courses delivered to Unit Standards, all candidates must hold an NSN. You can download the PDF file of the NSN application form (see downloads at the bottom of right column of the TOSHA website), complete the form, send it to TOSHA and we can make the application on your behalf free of charge, OR you can apply to NZQA yourself.  If you want credits registered, there is an administration fee of $15.00 per candidate plus $1.50 per credit excluding GST.

LATEST  DOL  FINES
This section is to keep you advised of current Department of Labour OSH Fines.  Although this is public knowledge, TOSHA does not give company names but what the fine was issued for and the cost.

-  Largest fine ever imposed under the HSE Act for a non-fatal incident.
11 factory workers hospitalised with carbon monoxide poisoning from an LPG powered forklift was used inside a factory
   $110,000 with a further $3000 to each affected worker - total $143,000

-  Largest fine $225,000 for a fatality - worker crushed when a load fell from a faulty crane.  Previous largest fine had been imposed after worker's leg was
   amputated in a freight loader - $60,000.

Courts are now increasing the amount of the fine and not reparations, as reparations can be covered by insurance.  This means the actual fine is not considered to be the deterrant that it should.  Things are about to change.

Stress - Australia
Stress claims and the cost of are rising - average claim now $A115,000.  This does not cover the loss of production costs of stressed workers who remain in the workforce which has been estimated to be $A12,700 per worker on an annual basis.

Managers Jailed UK
A Managing Director of a concrete company has been jailed for 12 months, and its Area Manager for 9 months after pleading guilty to manslaugher charges following the death of an employee.  The employee was caught in a slew conveyor pit whilst trying to clear the belt while the machine was still running.  The machine was unguarded and had no stop button within reach.  At the time, the company had been subjected to 15 enforcement and prohibition notices relevant to life-threatening hazards involving work at height, transport, machinery lock-out, and the use of hydrochloric acid.  The fine equated to approximately $NZ492,000.
